OC Kaligis’ Case Continues

The Panel of Judges of the Corruption Court granted Otto Cornelis (OC) Kaligis’ request and once again delayed his trial. Separately, the registrar of PTUN Medan Syamsir Yusfan, one of the suspects accused of receiving bribe from OC Kaligis, had admitted to receiving bribe.

The Procedures for Foreign Journalists Visit is Cancelled

The Minister of Home Affairs (Mendagri) Tjahjo Kumolo canceled the Mendagri Circular No. 482.3/4439/SJ on the Adjustment of Procedure for Journalists Visiting Indonesia just two days after issuing the circular. Tjahjo cancelled the circular after President Joko “Jokowi” Widodo ordered him to do so. Not only that, Tjahjo also apologized for any misunderstanding.

Legislative Journal: The UU Migas Amendment Bill

The House of Representatives (DPR) have finally started to discuss the Bill to Amend Law No. 22/2001 on Oil and Gas (RUU Migas). On August 25, 2015, the House Commission VII held the first discussion meeting. The agenda of the meeting was to develop a list of experts to be summoned for inputs on the academic paper regarding the RUU Migas. During the meeting, the Commission VII also confirmed that the House would draft its own version of the bill, even though the Government’s version already exists.

The Case of TPPI

The results of investigation into the case of suspected corruption and money laundering involving PT Trans Pacific Petrochemical Indotama (TPPI) and BP Migas (now Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi — SKK Migas) will soon be handed over to the Attorney General’s Office. The Directorate of Specific Economic Crimes at the National Police’s Criminal Investigation Agency (Bareskrim) is reportedly awaiting the results of the official calculation of the element of state loss from the Supreme Audit Agency (BPK) before moving into the stage of prosecution.

KPK v. Kaligis

Yesterday (Aug. 24) the South Jakarta District Court rejected the pretrial petition filed by Otto Cornelis “OC” Kaligis. The senior lawyer’s attempt to escape from the Corruption Eradication Commission’s (KPK) investigation has fallen apart.

Regulatory Uncertainty

The amendment to Government Regulation (PP) No. 46/2015 on the Implementation of the Elderly Security Program (JHT) has been well-received by workers. But the credibility of the government led by President Joko “Jokowi” Widodo is increasingly under question because of the lack of care they take in publishing new regulations; resulting in almost instantaneous issuance of amendments. The process of amending PP No. 46/2015, for instance, was made two days after its initial publication.

Victoria Securities v. Adistra Utama: Updates

The case of alleged corruption related to the Indonesian Bank Restructuring Agency’s (BPPN) sale of right to collect debt (cessie) implicating PT Victoria Securities and PT Adistra Utama has just gotten more complex. The Attorney General’s Office (AGO), who had previously raided the office of PT Victoria Securities Indonesia (VSI), is being accused of raiding the wrong office. To make things worse, the search warrant the AGO used allegedly violated the existing procedure. VSI launched a protest on said matters, and went to the House Commission III of the House of Representatives for help.
