The long-awaited regulation meant to protect officials from being criminalized for taking risks with policy making has finally been published. This regulation was signed by President Joko “Jokowi” Widodo in the form of Presidential Instruction (Inpres) No. 1/2016 on the Acceleration of the Implementation of the National Strategic Projects.

Peace for Duta Palma Nusantara

PT Duta Palma Nusantara’s Suspension of Debt Payment (PKPU) process ended in peace. The plantation company reached peace deals with the majority of its creditors, after being in PKPU since December 18, 2015 at the request of one of its creditors PT Mega Eltra. This was Mega Eltra’s second request for Duta Palma Nusantara’s PKPU after the former’s first request was rejected by the court on November 23, 2015.

Abdul Khoir, Damayanti and the Trans-Seram Project

Abdul Khoir, the director of PT Windhu Tunggal Utama (WTU), was arrested by the Corruption Eradication Commission (KPK) on January 13, 2016 on the same time the KPK arrested the member of the House Commission V of the House of Representatives Damayanti Wisnu Putranti of PDI-P and her two staffs, Dessy A Edwin and Julia Prasetyarini.

The End for Amir Fauzi?

The Corruption Court in the Central Jakarta District Court read the verdict on the graft case involving the Medan Administrative Court (PTUN Medan) Judge Amir Fauzi on January 27, 2016. Amir is one of the three judges who received bribes from the senior advocate Otto Cornelis Kaligis related to the handling of an embezzlement case in the province of North Sumatra.

Solaris Prima v. Syariah Mandiri and Kutilang Paksi Mas (Part II)

The dispute concerning a breach of contract between PT Bank Syariah Mandiri (BSM) and PT Solaris Prima Energy (Solaris) continues. Both parties failed to reach an agreement at mediation. The case is now entering the stage of hearing. Solaris’ legal counsel Gita Petrimalia confirmed that an agreement was not reached because BSM refuses to pay the disputed bank guarantee. BSM’s legal counsel Rizaldi Pratomo Yudho was reluctant to disclose the reasons why his client refused to issue the bank guarantee to Solaris.

Lino Lost

The pre-trial contest between the former President Director of PT Pelabuhan Indonesia II (Persero) (Pelindo II) Richard Joost Lino against the Corruption Eradication Commission (KPK) is over. The sole presiding judge of the trial Judge Udjiati rejected Lino’s petition and decided that Lino’s determination as a suspect was legitimate. The KPK said that it would immediately conduct an official investigation against Lino in his capacity as a suspect.

Constitutional Court’s Verdict on Post-Election Disputes (3)

The Constitutional Court (MK) has only granted 1 of the 147 post-election dispute lawsuits registered by participants of the 2015 simultaneous regional elections—the MK has rejected 134 lawsuits, and 5 lawsuits were revoked by the plaintiffs. As such, from now on to March 7, 2016, the Court will only hear 7 post-election dispute lawsuits.

Damayanti’s Case Continues

The examination of the case of alleged bribery related to the project in the Ministry of Public Works and Public Housing (Kemen-PUPR) continues. After raiding offices in the parliament building and offices in Kemen-PUPR, the Corruption Eradication Commission (KPK) went to ambon to follow up on leads. The KPK have also issued a travel ban on some parties allegedly involved in this case.

Hutama Karya and Corruption in the Ministry of Transportation (Part II)

The Corruption Court of the Central Jakarta District Court heard the demands of the prosecutors against the former General Manager (GM) of PT Hutama Karya Budi Rachmat Kurniawan on January 25, 2016. Budi allegedly acted as the mastermind in the corruption of the Ministry of Transportation’s Phase III Development of the Education and Training Center for Marine Studies (BP21P). Budi is charged with 5 years imprisonment and an obligation to pay Rp300 million in fine subsidiary 6 months imprisonment.
