Post Election Disputes and Cases Related to Akil Mochtar
The Constitutional Court (MK) is expected to hold the trials on the dispute cases related to the 2015 simultaneous regional elections on January 7, 2015. Until today, 147 losing pairs from 134 regions have registered their petition, but we’re not going to discuss that. This atmosphere of political feud brought to our minds the memory of Akil Mochtar, the former chairman of the Constitutional Court who was convicted of receiving bribes in relation to election disputes that he oversaw as a Constitutional Court justice.
Another Lawsuit from Yayasan Supersemar
The dispute between the Government and Yayasan Supersemar will not be over anytime soon. On December 17, 2015, the Yayasan Supersemar filed a lawsuit against the Attorney General’s Office (AGO) and the President. The lawsuit resulted in the postponement of the aanmaning trial that would authorize the execution of the Supreme Court’s verdict against Yayasan Supersemar.
A Slight Relief for Angie Sondakh
The Supreme Court granted the petition for Reconsideration (PK) filed by the former Deputy Secretary General of the Democratic Party Angelina “Angie” Pingkan Patricia Sondakh. Angie filed her PK petition in May 2015, and her last resort effort paid off. The Court granted her PK on December 29, 2015, and so her sentence is to be reduced.
Bumi Mekar Hijau Escaped Punishment
The Government again conceded to companies suspected of spreading forest fires. On December 30, 2015, the panel of judges of the Palembang District Court rejected the lawsuit filed by the Ministry of Environment and Forestry (KLHK) against PT Bumi Mekar Hijau (BMH). BMH was deemed not guilty of committing unlawful act.
RJ Lino Tests His Luck
The former President Director of PT Pelabuhan Indonesia II (Persero) (Pelindo II) Richard Joost “RJ” Lino applied for a pre-trial against the Corruption Eradication Commission (KPK) at the South Jakarta District Court on December 28, 2015. Lino challenges the KPK’s decision to name him as a graft suspect in the case of procurement Quay Container Crane (QCC) units during the 2010 fiscal year.
Update on Gatot Pujo Nugroho’s Graft Case
On December 23, 2015, the Corruption Court in the Central Jakarta District Court commenced the trial on the graft case involving the disgraced Governor of North Sumatra Gatot Pujo Nugroho and his second wife Evy Susanti. Both were tried separately, but their indictments contain the same material. The pair were charged with two offences at once.
Updates on the Bill to Amend UU Migas
The House of Representatives (DPR) continues their discussion on the draft of the bill to amend the Law No. 22/2001 on Oil and Gas (UU Migas). Until today, the most prominent and publicly discussed issues is the status of SKK Migas. But given that we’re at the end of the year, the bill, which is already listed in the 2015 National Legislation Priority Program cannot be promulgated this year. As of now, the target is to get the bill passed into law in the plenary session in June 2016.
RJ Lino Dismissed
The rumor that’s been spreading since last week turns out to be true. The President Director of PT Pelabuhan Indonesia II (Pelindo II) (Persero) Richard Joost “RJ” Lino was indeed sacked. The surprising decision to get rid of Lino was made after he was declared a graft suspect by the Corruption Eradication Commission (KPK) in the scandalous procurement of 3 units of Quay Container Crane (QCC).
PKPU for AAA Investment
PT AAA Investment finally entered its period of Suspension of Debt Payments (PKPU). The investment company has until next month to record the total bills of debt they have amassed. The team administrating the PKPU have already set the deadline for the creditors to report on their bills until January 6, 2016.
The End for Patrice Rio Capella?
On December 21, 2015, the panel of judges at the Corruption Court in the Central Jakarta District Court finally read the verdict for the former Secretary General of the National Democratic Party (Partai Nasdem) Patrice Rio Capella. Patrice was sentenced to 1 year and 6 months in prison. He was also ordered to pay Rp50 million in fines, subsidiary 1 month imprisonment. The verdict is lighter than the demands of the public prosecutor, which is 2 years imprisonment.
