Jonan’s Transportation Reform: New Speed Limits

The Ministry of Transportation (Kemenhub) has issued a regulation defining speed limits for vehicles. The Minister of Transportation Regulation (Permenhub) No. PM 111/2015 is Jonan’s effor at suppressing the number of traffic accidents. This new initiative came as a result of an evaluation of the annual Eid migration event.

Updates on the Priok Port Corruption Case

Investigation into alleged corruption and money laundering related to the process of loading and unloading of goods (dwelling time) in the Priok Port continues. After raiding offices in the Ministry of Trade (Kemendag), the Jakarta Metropolitan Police are now targeting the Ministry of Industry (Kemeperin). As of the beginning of August 2015, the police had already summoned four witnesses from Kemeperin.

On the AGO’S New Tim-P4  

The Attorney General’s Office (AGO), under the leadership of HM Prasetyo, is slowly taking shape. In the midst of public attention for underperforming the AGO formed a special team called the Guardian, Government Security, and Development Team (Tim Pengawal, Pengamanan Pemerintahan, dan Pembangunan, otherwise known as Tim-P4). The team was established soon after President Joko “Jokowi” Widodo delivered his speech on July 22, 2015 to celebrate the birthday of the AGO.

Legislative Journal : Updates on the 2015 National Legislative Priority Program

The work performance of the House of Representatives (DPR) has been under scrutiny. Since August 2015, the DPR has only managed to enact 2 of the 39 bills that are on the list of the 2015 National Legislative Priority Program (2015 Prolegnas), i.e., the Law on the Election of Governor, Regent, and Major and the Law on Regional Governments. Of the 39 bills to enact this year, the DPR proposed twenty-seven of them, including the two mentioned laws. The 25 bills the DPR proposed are:

Amendment of Coal Contract of Works

Minister of energy and mineral resources Sudirman Said has on Wednesday (August 5) signed amendment of 10 coal contract of works pursuant to Law No. 4/2009 about Mineral and Coal. Among them are three coal contract of works (CCOWs) under PT Indo Tambangraya Megah (ITMG).

Judicial Review on the Requirements for Independent Candidate

The Constitutional Court (MK) still have a lot of examinations to do on various judicial review request on one law, i.e., the Law No. 8/2015 regarding Simultaneous Regional Elections. On August 3, 2015 the Court examined the judicial review request on said Law filed by M. Fadjroel Rachman. Fadjroel, a well-known political figure, is challenging the administrative requirements for independent candidates; candidates who chose to run in elections without the backing of any political party.

Judicial Review on the Law on OJK

The Constitutional Court (MK) rejected the judicial review on Law No. 2/2011 on the Financial Services Authority (OJK) proposed by the National Economic Sovereignty Defense Team (TPKEB). MK’s decision affirms the existence of the OJK as a constitutionally legitimate financial supervisory agency. The Court, however, provided some notes.

Bankruptcy Journal: ACA v. APOL

A debt problem resulted with a bankruptcy lawsuit between PT Asuransi Central Asia (ACA) and PT Arpeni Pratama Ocean Line Tbk (APOL). ACA would reportedly file for a cassation after their request for cancelling their peace agreement with APOL was rejected by the panel of judges of the Commercial Court of Central Jakarta.

Revisiting Illegal IUPs

The reconciliation for clean and clear mining permit (IUP CnC) that was carried out since August 2014 ended in June 2015. The Corruption Eradication Commission (KPK) and the Directorate General of Taxation (Ditjen Pajak) was been involved in monitoring the process in various regions. The Ministry of Energy and Mineral Resources (Kemen-ESDM) has evaluated at least 10.918 IUP, of which 6.042 IUPs have obtained the CnC certificate.

Priok Port Corruption Exposed

Investigation into the horrendous dwelling time in the Tanjung Priok Port have now turned into a corruption investigation. As of July 30, 2015, the Jakarta Metropolitan Police have named four suspects alleged of accepting bribes and further accused of money laundering.
