Robbing Military/Police Insurance Firm Asabri (1)

A decade ago, law enforcement agencies investigated allegation of corruption in the investments made by Asabri, a state insurance firm for military and police officers, implicating businessmen Tan Kian (property developer) and Henry Leo. We might soon see fresh investigation into Asabri’s reckless investment decisions in 26 stocks on Indonesia Stock Exchange (IDX).

Corruption Journal: the Kendari Dynasty, and the Manado High Court Bribery Case

The Corruption Eradication Commission (KPK) conducted another Sting Operation in the morning of February 28, 2018 and arrested the Mayor of Kendari in Southeast Sulawesi one Adriatma Dwi Putra together with his father and several other parties on account of bribery. The KPK later named four suspects in the case. Separately, the trial of the suspects of bribery in the Manado High Court finally began on February 28, 2018. The former Chief of Manado High Court one Sudiwardono, who took bribes from the member of House of Representatives one Aditya Moha, is known to fix prices in return for issuing letter for suspension of detention. He acquitted the former Bolaang Mongondow Regent one Marlina Moha Siahaan, who is Aditya’s mother.

Update on the E-KTP Graft Case: New Suspects

The Corruption Eradication Commission (KPK) announced on February 28, 2018 that they had two new suspects in the electronic identity card (E-KTP) procurement graft case. With the announcement, the KPK has eight suspects in the case, three of whom have been convicted. The two new suspects are:

Land Ownership in Yogyakarta and the Legal Power of Discretion

On February 20, 2018, the Yogyakarta District Court decided to decline the lawsuit filed by one Handoko, a lawyer and an Indonesian of Chinese descent. The lawsuit was filed to question the legal power of discretion, namely the Instructions of the Deputy Regional Head of the Special Region of Yogyakarta No. K.898/I/A/1975 which bars Non-Native Citizens (Non-Pribumi) from owning land in Yogyakarta. This is the third disappointing decision after the Supreme Court and the State Administrative Court previously declined to examine the lawsuit. The district court’s decision provide no explanation on why such discretion should be obeyed even though the State already has a variety of regulations on land ownership, and such instructions do not have a place in the hierarchy of legislation.

Update on the Transmart Cilegon Graft Case

The trial of the suspects of the Transmart mall construction graft case has ended. The Panel of Judges of the Corruption Court of the Serang District Court decided that all three defendants are guilty. The trial of the bribees—including the Mayor of Cilegon one Tubagus Iman Ariyadi (Iman)—, however, is still ongoing.

Update on the E-KTP Graft Case

Setya Novanto’s trial continues. The latest hearing (held on February 22, 2018) was the most interesting so far. A transcript of conversation between several parties was revealed, including the investigation conducted by the FBI against one Johannes Marliem. There was also an allegation that a member of the Supreme Audit Agency (BPK) was attempting to stop the investigation.

Finally, PKPU for Merpati Airlines

After years filled with lawsuits, the State-Owned PT Merpati Nusantara Airlines finally entered their period of Suspension of Debts Payment (PKPU). The PKPU is the result of a lawsuit filed by one of the Company’s creditors. The lawsuit was filed at the Commercial Court of the Surabaya District Court. And unlike the other district courts, the Panel of Judges this time agreed that though Merpati Airlines is a State-Owned company, they can still be sued by their creditors.

Many things happened on February 22, 2018. The Corruption Eradication Commission (KPK) attended three corruption trials and they detained a graft suspect they’ve targeted since 2016. Meanwhile the police succeeded in arresting a fugitive accused of graft involving PT Pertamina (Persero).

The Zero Down Payment Blunder (Part II)

Jakarta Governor Anies Baswedan’s Zero Percent Down Payment Home Ownership Program (The Zero Percent DP program) is, to say the least, controversial. After a series of bad press, the agreement made for the program’s implementation was reported to the Business Competition Supervisory Commission (KPPU) for allegedly violating the law. The party who filed the report said that they were planning to report the allegation to the Corruption Eradication Commission (KPK).
