The Sarpin Effect Continues

The existence of the Judicial Commission (KY) as the institution tasked with enforcing the code of conduct of judges is being seriously challenged. While being occupied with the selection process of new commissioner candidates, the Commission is facing a lawsuit filed by the Indonesian Judge Association (IKAHI) questioning KY’s authority in the recruitment of judges. To make the pressure even more intense, KY must now face the consequence of a defamation report filed by the notorious Judge Sarpin Rizaldi.

The KPK On the Move

On July 9, 2015, the Corruption Eradication Commission (KPK) Task Force arrested five people during a caught-in-the-act operation (OTT) in Medan, North Sumatra (Sumut). The five people comprise of three judges, a court clerk, and an advocate of the OC Kaligis & Associates law firm. This operation is believed to be related to the investigation of alleged corruption in the State Administrative Court (PTUN) of Medan.

On the Bank DKI’s Case

After two months of investigating Bank DKI’s granting of 230-billion-rupiah credit facility to PT Likotama Harum and PT Mangkubuana Hutama Jaya, the High Prosecutors of Jakarta (Kejati Jakarta) escalated their investigation to inquisition. The Kejati Jakarta reportedly had examined 10 witnesses.

Govt & Bakrie Deal on Lapindo Bailout

Minister of finance Bambang Brodjonegoro, on behalf of the government, has signed agreement with Tri Setia Sutisna and Andi Darussalam from Lapindo Brantas Inc and PT Minarak Lapindo Jaya with the consent from Nirwan Bakrie to provide bridge financing for the compensation of mudflow victims in Sidoarjo, East Java Friday (July 10).

Rearrangements Related to the Kemendesa

The debate on the allocation and distribution of village funds is a never ending headache. And now, in the thick of the discussion, the House of Representatives (DPR) decide to change the set up for their dealing with The Ministry of Village-Rural s Development and Transmigration (Kemendesa). In addition to that, there’s the amendment to Government Regulation (PP) No. 43/2014—the implementing regulations of Law No. 6/2014 of the village—into PP No. 47/2015.

Jonan’s Aviation Reform Continues

Under the leadership of Ignasius Jonan, the Ministry of Transportation (Kemenhub) is a much more interesting institution to follow. After reportedly revoking sixteen airline operating license, otherwise known as Air Operator’s Certificate (AOC) in mid-June 2015, The Kemenhub is now going after airline companies that cannot meet the provisions of aircraft ownership and unable to provide proper financial reports in accordance with the given time limit for reporting.

The Social Security Agency, BPJS Ketenagakerjaan

After the enactment of Law No. 40/2004 on National Social Security System, PT Jamsostek was transformed into the workers’ social security agency called BPJS Ketenagakerjaan. BPJS Ketenagakerjaan provides four kinds of protection for workers, namely, Work Accident Insurance (JKK), Death Benefit (JKM), Elderly Security (JHT) and Health Insurance (JPK). All four protection instruments are each regulated in a Government Regulation (PP), which was jointly promulgated at the end of June 2015.

OJK v. Bumi Asih Jaya

The bankruptcy dispute between PT Asuransi Jiwa Bumi Asih Jaya (BAJ) and the Financial Services Authority (OJK) continues. OJK reportedly filed another bankruptcy petition for the execution of liquidation to the Supreme Court (MA).
