Judicial Review Lawsuits against PKPU No. 20/2018
The debate on the plan to ban ex-graft-convicts from participating in legislative election will not end soon. The Ministry of Law and Human Rights refused to promulgate the regulation drafted by the General Election Commission (KPU), but even so the KPU still published the regulation on June 30, 2018 and it is now in effect. Several ex-graft-convicts who wishes to participate in the upcoming regional election decided to challenge the regulation at the Supreme Court.
Witness for the Defense: Jusuf Kalla
Suryadharma Ali, the former Minister of Religious Affairs who’s now a graft convict, filed a Reconsideration (PK) petition at the Supreme Court last month. The trial began two weeks after that and Suryadharma still claim innocence. What’s interesting to note from the trial is the presence of Vice President Jusuf Kalla as a witness for Suryadharma. This is the fourth time Jusuf Kalla has attended trials of cases of corruption as a witness for the defense.
Corruption Journal: On the Jambi and Aceh Graft Case
It has been over six months since the Corruption Eradication Commission (KPK) conducted a Sting Operation in Jambi but the investigation continues. Meanwhile, the KPK is also continuing to investigate graft in Aceh. They recently announced that they have found more evidence.
Triomas Forestry v. Ministry of Environment and Forestry
PT Triomas Forestry Development Indonesia (TFDI), a supplier for Asia Pacific Resources International Holdings Limited (APRIL)—a part of the Royal Golden Eagle Group (RGE) owned by Sukanto Tanoto—got into a dispute with the Government in 2014. The Company was allegedly negligent and caused forest fires in their concessions in Riau. Trial began in February 2018. The Siak district court is responsible for examining the proceedings.
On the PKPU for Meikarta: Dispute Continues
The trial of lawsuit for Suspension of Debts Payment (PKPU) filed against PT Mahkota Sentosa Utama (MSU), the developer of Meikarta township project, ended last week when the Panel of Judges decided to decline the lawsuit. The Panel of Judges stated that the dispute was too complicated to be resolved in a PKPU. On the same day, however, the plaintiffs registered a new lawsuit concerning the same dispute, stating that they will keep fighting. The dispute has now grown more serious after MSU reported the two plaintiffs to the police on suspicion of fraud.

The BLBI Graft Case
The Corruption Court of the Central Jakarta District Court continued the trial of Syafruddin “Syaf” Arsyad Temenggung, the former chairman of the Indonesia’s Bank Restructuring Agency (BPPN), who is now a defendant in the Bank Indonesia Liquidity Assistance (BLBI) graft case. In the latest hearing, the court listened to accounts of important witnesses including Rizal Ramli and Kwik Kian Gie.
More on the Sting Operation in Aceh
The Corruption Eradication Commission (KPK) named the Governor of Aceh Irwandi Yusuf a suspect of graft following the Sting Operation they conducted two days ago. The KPK also named three other suspects in the case. What’s important in this case is that the KPK uncovered the corrupt practice that has been feared for so long: the misuse of Aceh’s special autonomy funds.
Share Ownership Disputes in Blue Bird
PT Blue Bird Tbk (BIRD), its subsidiaries, and the parties around the companies have gone through a share ownership disputes since 2013. We recorded dozens of similar lawsuits filed at the South Jakarta District Court, this is of course not including the other lawsuits filed in other district court. In 2014, one Lani Wibowo and one Elliana Wibowo filed a lawsuit against PT Big Bird and dozens of other individuals, including the Financial Service Authority (OJK), demanding the court to recognize them as the rightful owners of shares in the company. The district court rejected the lawsuit but the High Court overruled the verdict in 2016. On the stage of cassation, the Supreme Court decided to uphold the High Court decision. On July 3, 2018, BIRD announced the cassation verdict in the disclosure of information to the Indonesia Stock Exchange.
