Corruption Journal: Chasing Fugitives

For the past three years, the Corruption Eradication Commission (KPK) has faced public scrutiny due to many corruption suspects’ escape. The KPK’s commitment was questioned. Recently, the KPK stated that it would form a Special Task Force (Satgas) tasked with pursuing fugitives on the wanted list (DPO). So far, seven suspects are the KPK’s primary targets.

Although the Islam Defenders Front (FPI) has been declared a prohibited organization, we may still hear news of them. The most recent of which concerns its dispute with a state-owned company. Many have reported on this dispute, but few provide detailed explanations.

FPI and the International Criminal Court 

The clash between police officers from the Jakarta Metropolitan Office and dozens of paramilitary members of the Islamic Defenders Front (FPI) (otherwise known as Laskar FPI) left many questions not only regarding the chronology of events but also on the legality of the actions taken by the officers. Several parties have conducted investigations related to this incident in the country, ranging from internal inspections of the National Police (Polri) to the National Human Rights Commission (Komnas HAM). However, the investigations carried out were not satisfactory for FPI. It submitted a request for examination to the International Criminal Court (ICC). Anyone who knows the ins and outs of international law must understand that FPI’s efforts are futile.

Vinmar vs Sumi Asih

Bankruptcy lawsuit against Noble’s Pinang Export

PT Pulau Seroja Jaya, a coal transportation services company, has on January 22, 2021 filed a bankruptcy lawsuit against PT Pinang Export Indonesia, subsidiary of the troubled SGX-listed commodities trading Noble Group, to the Central Jakarta District Court.

2021 PKPU/Bankruptcy Journal: Bumi Hasta Mukti

On Jan. 20, 2021, the Commercial Court of the Central Jakarta District Court registered a lawsuit for Suspension of Debts Payment (PKPU) against PT Bumi Hasta Mukti (PT BHM). The Court did not publish more information about the lawsuit, but this is not the first time the Company must deal with legal issues. Within the last three years, there are already three PKPU lawsuits filed against the Company. PT BHM managed to avoid bankruptcy until today, but can it escape the latest lawsuit as well?

Allegation of Corruption in BPJS-TK

The Attorney General’s Office (AGO) strikes again. The AGO is investigating allegations of corruption involving the Social Security Agency for Employment (BPJS Ketenagakerjaan or BPJS-TK). There are allegations that what happened in Jiwasraya has also happened in BPJS-TK. The Minister of Manpower and BPJS-TK firmly dismissed the allegations, but many think that the AGO is trying its luck.

Corruption in LAPAN and BIG

The Corruption Eradication Commission (KPK) begins 2021 by announcing an investigation into a new case of corruption. What’s interesting about this announcement is that the case concerns two non-ministerial, state institutions, whose roles are important but barely known to the public. The two institutions in question are the National Aeronautics and Space Institution (LAPAN) and the Geospatial Information Agency (BIG). The KPK conducted an examination on Jan. 20, 2021. 2021 PKPU/Bankruptcy Journal: More on Pollux Group

Last year was a challenging year for Pollux Group. In addition to financial difficulties, the Group had to face many lawsuits, mostly seeking debt restructuring (PKPU). Although the Group escaped some of the lawsuits, the start of 2021 is not any better. So far, four PKPU lawsuits have been filed against the Group. In addition to that, PT Pollux Aditama Kencana (PT PAK) is also in a dispute.
