Back in July 2023 the Corruption Eradication Commission (KPK) uncovered a case of alleged corruption which caused an unexpected drama. The operation was conducted related to an alleged corruption in a project belonging to the National Search and Rescue Agency (Basarnas), then the KPK officially named five suspects in this case, including the Chief of Basarnas, Air Marshal Henri Alfiandi. Henri allegedly received grafts worth a whooping Rp88 billion (nearly US$6 million) in just two years. Amidst the public’s shock, however, the TNI caused a commotion. They protested the KPK’s decision because two suspects were active military officers. After facing backlash from the public, the situation calmed down a bit and the two institutions agreed to work together. This week the trial of the civil suspects began.

Re-managing the Sultan Hotel : New Lawsuit

PT iGrow Resources Indonesia (iGrow), which claims to be the first agricultural peer to peer lending platform in Indonesia, finally had its turn to face problems as 40 of its investors filed a tort lawsuit to the South Jakarta District Court back in June 2023. The plaintiffs accused iGrow of defaulting. This is the second of such cases in the agribusiness lending business after previously TaniFund, the lending arm of the agritech company TaniHub, also faced default. In iGrow’s case, the mediation stage ended with no agreement between the parties, but luckily, the plaintiffs decided to withdraw the lawsuit.
On Corruption in Hulu Sungai Tengah
The case in Hulu Sungai Tengah (HST), South Kalimantan was uncovered during the KPK’s sting operation in January 2018. Similar to the cases that ensnared the other regional leaders, the case was also related to construction projects conducted by the regional government but with illegal agreements with the contractors of the project. The suspicion is that PT Menara Agung Pusaka led by one Donny Witono agreed on a commitment fee with several parties, including the Regent of HST one Abdul Latif, to obtain a certain project. Commitment fee agreed to was 7.5 percent of the total value of the project or approximately Rp3.6 billion. To speed up the payment realization of the commitment fee, the Regent supposedly promised the Company to be given responsibility in another big project which would be conducted in 2018.
Suspect Syahrul Yasin Limpo
The Corruption Eradication Commission (KPK) finally officially announced that they had named three suspects in the latest case of alleged corruption in the Ministry of Agriculture, one of whom is the Minister of Agriculture, Syahrul Yasin Limpo. This is in line with the news circulating after the KPK searched the official residence of the Minister on Thursday, Sept. 28, 2023 evening. Syahrul managed to pull some antics before finally deciding to resign from his position earlier this month. Interestingly, on the same day the KPK announced the case, Syahrul already filed a pre-trial petition. This could only mean that Syahrul had been named as suspect for a while now.
On Corruption in Aneka Tambang
Dody Martimbang, former officials of PT Aneka Tambang Tbk (ANTM) was found guilty by the Panel of Judges of the Corruption Court at the Central Jakarta District Court. Dody was named suspect in a case of alleged corruption which initially ensnared the Director of PT Loco Montrado, Siman Bahar. Siman managed to escape legal consequences after he won the pre-trial in which he questioned the KPK decision to name him as suspect back in 2021, but the KPK was determined enough to name Siman as suspect for the second time earlier this year. With the decision on Dody, we wonder if Siman will finally stand trial.
Satgas BLBI v. Andri Tedjadharma
We all know that the term of office of the Satgas BLBI (Satuan Tugas Penanganan Hak Tagih Negara Dana Bantuan Likuiditas Bank Indonesia) will soon be over. Regardless of whether there will be an extension of time, until now there are still many obstacles that have arisen, including legal challenges. This week, Andri Tedjadharma (with links to Bank Centris Internasional) filed a second lawsuit.
Harita Group v Local Residents
PT Gema Kreasi Perdana (PT GKP), one of Harita Group’s many subsidiaries, began operations in 2022 on Wawonii island in the Konawe Islands (Konawe Kepulauan – Konkep) regency in Southeast Sulawesi. The company operates with a license on a lease-to-use forest area (IPPKH) granted in 2014 for nickel ore mining production operations and supporting facilities in limited production forest areas and production forest areas. Since starting operations, the company has faced resistance from many parties. In the middle of this year, representatives of local residents and environmental activists filed a lawsuit to the Jakarta State Administrative Court (PTUN) asking the court to cancel said IPPKH. Last month, far from the media spotlight, the lawsuit was granted. What does this mean for Harita Group?
