Koapgi v Developer
Koperasi Awak Pesawat Garuda Indonesia of the Garuda Indonesia Flight Crew Cooperative Union (Koapgi) was caught in a vortex of residential complex construction fraud several years ago and lost tens of billions of rupiah. In 2021, Koapgi filed a lawsuit against the developer, PT Satiri Jaya Utama, and won. This week, the decision was confirmed by the Supreme Court.
Road to 2024 Election : Protecting Whistleblowers
On Dec. 12, 2023, the General Election Commission (KPU) held the first official debate for the three 2024 presidential candidates. The debate was held with focus on legal issues, including Human Rights (HAM), corruption eradication, and strengthening democracy, basically the main issues in Indonesia. As usual, we see how the candidates convey their promises plus a little sarcasm between each other. The debate is interesting considering that each candidate is supported by political parties that are vulnerable to violations of the law. However, there is one topic in particular that caught our attention, namely Anies Baswedan’s promise to give bigger rewards to whistleblowers. If there is one thing that has almost never been discussed thoroughly, it is the protection for whistleblowers and witnesses of corruption cases. What’s the use of billions of rewards if their safety cannot be guaranteed?
On Corruption in Bandung
The trial of Yana Mulyana, the disgraced mayor of Bandung (a politician from Prabowo’s Gerindra), and two other bribee just ended. Without much attention, Yana was found guilty of corruption.

On the Railway Corruption Case
The trial of three bribee in the case of corruption involving railway projects at the Directorate General of Railways at the Ministry of Transportation ended this week. The three defendants, who were officials of the Directorate General, have been found guilty.
Kayan Hydro v Ministry of Public Works
The Kayan Cascade Hydroelectric Power Plant (PLTA) located in North Kalimantan is said to be the largest hydropower plant in Southeast Asia because it will use an area of more than 2,600 hectares and five dams to generate 9,000 MW of electricity. The development of this hydropower plant has been discussed since 2011, with initial cooperation with investors from China. However, there is not much news about the progress of the project until in early October 2022, when the initiator of the PLTA Kayan, PT Kayan Hydro Energy (PT KHE) signed a construction agreement with Sumitomo Corporation. Earlier this week, various national media outlets reported that PT KHE has completed all construction permits, however, the company has actually filed a new lawsuit against the Ministry of Public Works. This is apart from several other cases that are still ongoing.
ACST v Surya Indonesia Satu Property
The dispute between PT Media Property Indonesia (PT MPI, a part of Surya Paloh —NasDem, Media Group), and PT China Sonangol Media Investment (PT CSMI) and its holding CS Real Estate Pte Ltd was over a couple of years ago after years of uncertainty. At the end of 2021, PT CSMI changed its name to PT Surya Indonesia Satu Property (PT SISP). But problems still follow the company. Two years after debt restructuring efforts ended in peace, this week several creditors filed a lawsuit seeking to cancel the peace agreement. One of the creditors in question is PT Acset Indonusa Tbk (ACST).
