Benny Tjokro v. Goldman Sachs et al

Five months have passed since the stock trader Benny Tjokrosaputro filed a lawsuit to the South Jakarta District Court against Goldman Sachs International and two other parties related to alleged illegal sales of Benny’s shares in PT Hanson International Tbk (MYRX). In the hearing held on February 28, 2017, Benny’s legal counsel submited their replik (a reply to the defendant’s plea) in response to the counter-lawsuit submitted by Goldman Sachs International.

Update on the PKPU of Humpuss Pengolahan Minyak

PT Niman Internusa’s Suspension of Debts Payment (PKPU) lawsuit against their debtor PT Humpuss Pengolahan Minyak (HPM), a subsidiary of PT Humpuss belonging to Hutomo Mandala Putra, was granted by the Panel of Judges of the Commercial Court at the Central Jakarta District Court on February 27, 2017. With this decision, HPM must enter their period of temporary PKPU for the next 45 days.

OC Kaligis Fights for Reconsideration

Five months have passed since the Supreme Court decided to decline the Cassation filed by Otto Cornelis (OC) Kaligis, the senior lawyer who’s found guilty of bribing three judges and a registrar of the Medan State Administrative Court (PTUN Medan). Kaligis filed for a Reconsideration (PK) then after, and on February 27, 2017, the Central Jakarta District Court held the preliminary hearing for Kaligis’ petition for PK.

Investigation into the Pelindo II Graft Case Continues

It has been a while since the last time the Corruption Eradication Commission (KPK) mentioned their investigation into the allegations of corruption and abuse of power in the procurement of 3 units of Quay Container Crane (QCC); the case that brought down the former President Director of PT Pelabuhan Indonesia II (Pelindo II) (Persero) Richard Joost (RJ) Lino. In the past two weeks, the KPK seemed to have resumed the investigation by summoning several witnesses.

Another Graft Defendant Acquitted

The Corruption Eradication Commission (KPK) must face a defeat in the Pekanbaru Corruption Court on February 23, 2017 after the Panel of Judges decided to acquit the Regent of Rokan Hulu, Riau, Suparman (Golkar) from corruption charges. Suparman was named a suspect on the case of alleged bribery related to the discussion of the draft of the Province’s 2014 and 2015 regional budget (R-APBD). The KPK quickly decided to file for a cassation.

Cal Dive v. Pertamina: End of the PKPU Trial

PT Cal Dive Offshore Indonesia (Cal Dive Indonesia), a subsidiary of Cal Dive International Inc once again failed to force the Technical Assistance Contract (TAC) Pertamina and PT Pertalahan Arnebatara Natuna (PAN) to pay the compensation mandated by the decision of the Indonesian National Arbitration Board (BANI). The effort failed after the Panel of Judges of the Commercial Court at the Central Jakarta District Court decided to reject the lawsuit for Suspension of Debts Payment (PKPU) that Cal Dive Indonesia filed.

Update on the Trial of Amran Mustary

Amran Mustary, the former head of the IX National Roads Implementing Board (BPJN IX), is now being tried for corruption related to the Trans-Seram road project; the scandalous project that brought down the former member of the House Commission V of the House of Representatives Damayanti Wisnu Putranti (PDI-P) and the President Director of PT Windhu Tunggal Utama Abdul Khoir. Amran’s trial never ceases to amuse. In the last hearing held on February 22, 2017, Amran is accused of providing “holiday allowances” for 25 officials in the Directorate General of Highway of the Ministry of Public Works and Public Housing. The total amount of allowances that Amran allegedly provided was Rp750 million and 4 witnesses presented by the Public Prosecutors confirmed this allegation.

Corruption in the Ministry of Manpower

The Corruption Eradication Commission (KPK) continues to investigate the allegations of corruption in the management of the Rp150 billion of optimizing funds of a Directorate General in the Ministry of Manpower and Transmigration. The KPK has prosecuted one convict, and named Golkar politician Charles Jones Mesang as a new suspect in December 2016.

Bambang Soeharto, Hanura, and the Unfinished Trial

On February 22, 2017 the new Central Executive Board (DPP) of Hanura, under the leadership of Chairman Oesman Sapta Odang, was sworn in. One of the politicians whose oath was taken was Bambang Wiratmadji Soeharto, who is now the deputy chairman of the Advisory Council. Bambang, however, is tangled up in a bribery investigation related to the Chief Prosecutor of the Praya Prosecutor’s Office of Lombok. Bambang has been a suspect since 2014 and his case has been on trial since 2015. But the trial was postponed due to Bambang’s health, and to this day it has not resumed. Whatever happened to Bambang being sick? Is he healthy again now that he’s a member of Hanura’s new DPP Board? Will his trial resume in the near future?

Gulf Manganese vs Marthen Amtiran

ASX-listed Gulf Manganese Corporation Ltd announced on Monday that it has terminated the binding agreement with Marthen Amtiran to invest US$10 million for 10% equity in PT Gulf Mangan Group, which plans to develop manganese smelter in Kupang, East Nusa Tenggara.
