Latest on the Cooking Oil Hullabaloo

In mid 2022, the investigation into allegations of corruption at the root of the problem which caused the cooking oil shortage and price surcharge developed after the Attorney General’s Office (AGO) announced that it had named three groups of companies as suspects. However, until now there are still many questions remaining, especially regarding the Government’s responsibility. The companies tried to file a State Administrative lawsuit against the Minister of Trade soon after and received interesting decisions. This week, the companies once again tried their luck and filed for different lawsuits to the Central Jakarta District Court.

PKPU for Waskita Karya

The Panel of Judges of the Commercial Court at the Central Jakarta recently decided to denied the PKPU lawsuit filed by PT Bukaka Teknik Utama Tbk (BUKK) against PT Waskita Karya (Persero) Tbk (WSKT), that was the third PKPU lawsuit filed by Bukaka within only a year. Waskita Karya announced the decision and had mentioned that the lawsuit did not affect the company’s operation. But the good news did not last long as new PKPU lawsuits were filed just days after that.

Election Dispute and Nepotism Loophole

The much anticipated general election results dispute (PHPU) ended with the expected outcome. The Assembly of Justices of the Constitutional Court is of the opinion that the petitions in both lawsuits are legally groundless in their entirety and thus strengthen the position of Prabowo Subianto and Gibran Rakabuming Raka as winners of the 2024 election. This decision was not unanimous as there were three Justices who expressed dissenting opinions. However, there is something else that interests us, namely how arguments about nepotism can give rise to new problems in the future.

Samadikun Hartono v Satgas BLBI

This year will be the last year for the Satuan Tugas Penanganan Hak Tagih Negara Dana Bantuan Likuiditas Bank Indonesia (Satgas BLBI) to complete their duty. Despite continuing to give pressures and succeeded in forcing several obligors to repay their obligations, there was still resistance from many parties, one of them is Samadikun Hartono. Samadikun, who is part of the Modern Group family, recently filed a civil lawsuit against the Satgas.

Election Dispute and Amicus Curiae

We all know what happens after the 2024 general election. Prabowo Subianto and Gibran Rakabuming Raka won the contest for presidential candidate and vice presidential candidate by winning the most votes defeating the other two pairs, but this victory was challenged by the two losing pairs. The team representing Anies Baswedan-Muhaimin Iskandar and Ganjar Pranowo-Mahfud MD all filed a lawsuit over the general election results dispute (PHPU) to the Constitutional Court. The examination has been completed since April 16, 2024 and was marked by the submission of amicus briefs by more than 50 amicus curiae. What’s that? Will it affect the Justices’ decision? The Assembly plans to read their decision today, April 22, 2024.

On Corruption in Southeast Sulawesi

The Corruption Eradication Commission (KPK) conducted sting operations in 2021 and uncovered the case of alleged corruption in Kolaka Timur, Southeast Sulawesi. Among those arrested at the time was then Regent, Andi Merya Nur (NasDem Party politician). Andi Merya was named as a suspect in two related cases for allegedly bribing an official at the Ministry of Home Affairs. The Regent’s attempt to take advantage of the regional National Economic Recovery (PEN) funds is at the heart of the case. The parties in the case had been found guilty in 2022, but the KPK did not stop investigating as they found another entrance to a similar case. The inquisition began in July 2023 but only officially announced towards the end of the year. Court proceedings continue far from media coverage and this week, nearly three years after the predicate crime was uncovered, the prosecutors had read their demands.

Latest on the Battle against Perpetrators of Forest Fires 

Back in 2019, in addition to suing PT Sari Asri Rezeki Indonesia (PT SARI) for the forest fires on their concession, the Ministry of Environment and Forestry also sued several other companies at the same time through several different district courts. Below are the updates on the legal process. 

Latest on Corruption in Sidoarjo

The Corruption Eradication Commission (KPK) began 2024 with a Sting Operation in East Java. This time, the KPK succeeded in securing a number of parties and uncovering a case of alleged corruption in Sidoarjo. After the initial investigation, interestingly, the KPK only named one suspect. After a couple of weeks, towards the end of February 2024, the KPK named a new suspect. The decision by then is interesting because the chronology of events reveals allegations that the proceeds of corruption were used for the Regent’s interests, but the Regent was still a free man, until this week. The KPK finally announced that they had named the Regent as suspect.

Satgas BLBI v. Andri Tedjadharma : Auctions 

The Satgas BLBI (Satuan Tugas Penanganan Hak Tagih Negara Dana Bantuan Likuiditas Bank Indonesia), a task force under Minister of Finance Sri Mulyani Indrawati’s supervision to recover funds related to the 1997-1998 financial crisis, had resumed working after their term of office was extended until the end of this year. And as we all know, through their working period until now there are still many obstacles that have arisen, including legal challenges. Earlier this month, we learned that Andri Tedjadharma (with link to Bank Centris Internasional) filed a new lawsuit regarding the process. This is the third lawsuit Andri filed within the past two years. This week, the Ministry through the Directorate General of State Assets published an announcement on the second attempt to auction the assets of Bank Centris Internasional.

On the Battle against Perpetrators of Forest Fires: PT SARI 

We all know the severity of the forest fires that occurred in between 2015 to recently, which affected Sulawesi, Kalimantan and Sumatera, and also neighboring countries. The Government acted quickly and pursued accountability from the perpetrators, especially the owners of the burned land. Several legal processes are still ongoing today. Not long ago, the Government through the Ministry of Environment and Forestry finally won a case against one of the companies.
