Mercury Overseas Finance Ltd and PT Dabi Oleh have on July 13, 2017 filed lawsuit against Wuxi Humei Thermal Energy and Energy Power Engineering Co Ltd, PT Muxi Boiler Power Plant Indonesia, DBS Bank Singapore, and China Construction Bank Corporation (CCBC).

Miryam’s Indictment

On July 13, 2017, the Corruption Court of the Central Jakarta District Court held the first hearing on the trial of Miryam S. Haryani, the Hanura politician and former member of the House Commission II of the House of Representatives, who was named a suspect of perjury related to the E-KTP graft case. The first hearing was held briefly with the agenda of hearing the prosecutors’ indictment for Miryam. Miryam stood firm and denied the charges in the indictment.

Legislation Journal: Perppu No. 2/2017 and the Disbandment of Ormas

On May 8, 2017, the Government of Indonesia announced the plan to disband the notorious community organization (Ormas) Hizbut Tahrir Indonesia (HTI). The Coordinating Minister for Politics, Law, and Security Wiranto said that HTI had to be disbanded because their activities spurred division in the community, which can threaten security and public order, and endanger the integrity of the Republic. But the decision was faced with one obstacle: the Law No. 17/2013 regarding Ormas. The law explicitly states that in order to disband an Ormas, the Government must file for lawsuit at the district court, a process that consumes a lot of time. To avoid a lengthy process, the Government decided to change the provisions of the law by promulgating the Government Regulation in Lieu of Law (Perppu) No. 2/2017 to revise the Law No. 17/2013.

Peace for Sujaya Group

Le Minerale v. Aqua

PT Tirta Fresindo Jaya (TFJ), a manufacturer of Bottled Drinking Water (AMDK) under the Le Minerale brand is involved in a dispute in the Business Competition Supervisory Commission (KPPU) against two of their rivals: PT Tirta Investama (TI is producer of Aqua) and PT Balina Agung Perkasa (BAP is a distributor of Aqua). The dispute was examined after statements from some sellers that Aqua producers and distributors asked them not to sell the Le Minerale brand. The prohibition was even reportedly accompanied by threats and intimidation that meet the allegation of elements of monopolistic practices and unfair business competition. The trial of this dispute has been ongoing since May 2017.

Updates on the E-KTP Graft Case

The investigation into the electronic identity cards (E-KTP) procurement graft case continues. The Corruption Eradication Commission (KPK) is now focusing on examining the politicians that are allegedly involved in the case. Since the first week of July 2017, the KPK has been examining several key persons in the case including the Minister of Law and Human Rights Yasonna H. Laoly, and several active members of the House of Representatives. The KPK even said that they had conducted a case reconstruction to name a new suspect in the case. The KPK also tried to examine the Speaker of the House of Representatives Setya Novanto (Golkar).

PT Megalestari Unggul, Bank Artha Graha and Paulus Tannos (Part I)

On July 5, 2017, the team of curators responsible in the insolvency process of PT Megalestari Unggul and Paulus Tannos’ family said to the media that they had managed to sell family assets in the form of shares of a company located in West Java. We thought that this meant Paulus Tannos’ family was being cooperative, but that is not the case. Paulus Tannos, Lina Rawung, Catherine Tannos and Pauline Tannos through their team of legal counsels published a statement dated July 8, 2017 in Tempo’s weekend newspaper. On behalf of the family, the legal counsels rebutted the statement of the curators and stated their version of the story. The counsels also warned the curators not to conduct any transaction on the family’s assets.

Bankruptcy Journal: Citra Maharlika, Megalestari and Paulus Tannos

PT Citra Maharlika Nusantara Corpora Tbk (CPGT) (formerly known as Cipaganti) was declared bankrupt in April 2017. But the team of curators was not handed an easy job because the process of asset inventory had many obstacles. In another bankruptcy process, the team of curators responsible for the insolvency process of PT Megalestari Unggul and Paulus Tannos’ family had managed to sell family assets in the form of shares of a Company located in West Java. The value obtained, however, is not enough to repay the debts.
