Revisiting the Antaboga Case: Hartawan Aluwi’s Reconsideration

It’s been a while since the last time we visited the case of PT Antaboga Delta Sekuritas. The Company was an investment company owned by Bank Century’s Robert Tantular, who was deemed responsible for the material losses experienced by its customers back in 2011. The last time we reported on the progress of the case was two years ago when the Surakarta District Court decided to execute the legally binding verdict, but it is just too late. Bank Century was ordered to compensate for the damages and Bank J Trust Indonesia, the current name of Bank Mutiara, which is the precursor of Bank Century, refuses to do so. You might remember that a year before the district court decided to execute the verdict, the law enforcer finally arrested Hartawan Aluwi. Hartawan was found guilty in the case for allegedly helping Robert in committing the crime. Hartawan decided to file for a Reconsideration recently, and the Supreme Court had registered his petition.

Latest on PT KAI v. Duta Anggada Realty 

The dispute between PT Kereta Api Indonesia (Persero) (KAI) and PT Duta Anggada Realty Tbk (DART), a property company controlled by Angkosubroto’s family, over the ownership of a plot of land in Kampung Bandan had begun since last year. The KAI decided to bring the dispute to court only to find out that the Panel of Judges of the North Jakarta District Court declare their lawsuit cannot be accepted. The State-Owned Company decided to file an appeal, and so does DART. The examination process continues to this day.

On Allegation of Cartel-like Practices in the Aviation Industry

The allegations of cartel practices related to soaring ticket rates and cargo transportation in the national aviation industry have emerged since the end of 2018, and until now the Business Competition Supervisory Commission (KPPU) continued to try to examine these allegations. A few months ago, the KPPU stated that they had escalated the status of research on the report of the allegations to an official investigation. At this stage, the investigators should gather the evidence needed to continue the investigation to the examination stage. However, this process is not easy because the KPPU considers the parties involved in this allegation, namely Garuda Indonesia and Sriwijaya Air, to be uncooperative. Recently, KPPU even threatened to report this matter to the police if the parties were still absent from the investigation process.

Latest on the Riau Power Plant Graft Case : Sofyan Basir’s Trial 

The trial of Sofyan Basir, the former President Director of PT PLN (Persero) who is a suspect in the Riau Power Plant graft case, has begun. The first hearing of the trial was held on June 24, 2019. The Court listened to the Prosecutors’ indictment for Sofyan. And although until today Sofyan insists that he is not guilty, several things mentioned in the indictment states otherwise.

Development on the Dispute in Kawasan Berikat Nusantara 

Last week we reported on the continuation of the dispute between PT Kawasan Berikat Nusantara (Persero) (KBN) and PT Karya Citra Nusantara (KCN) because representatives of the two parties had begun a media war, each claiming that they are the right ones. Amid all the complexity of the dispute, we almost forgot a significant development, that in addition to the ongoing dispute with the court proceedings, there is also the suspicion that the President Director of KBN one Sattar Taba along with one other party are involved in an embezzlement case. The police are investigating this case, but at the end of last week, we learned that an organization had submitted a report on allegation of corruption against Sattar Taba to the Corruption Eradication Commission (KPK).

On Cemerlang Abadi’s Case

It has been over a year since we learned about the allegation of violations committed by PT Cemerlang Abadi, a palm plantation company, in running their operation, and also the allegations of environmental crimes the Company committed. The last time the local media outlet reported on the case was back in October 2018, when the regional police summon the Company’s president director to be examined. But since then there is no other news regarding the continuation of the investigation. On June 19, 2019, however, the Jakarta State Administrative Court registered a lawsuit filed by the Company against several parties including the State Minister for Agrarian Affairs and Spatial Planning. What is going on?

On the Cirebon Graft Case: Development

As we previously reported, the KPK confirmed on October 24, 2018, that they had arrested seven individuals, including the Regent of Cirebon Sunjaya Purwadisastra. Sunjaya (PDI-P) allegedly received bribes from businesspeople in the region and also abused his power as a regent. Sunjaya demanded compensation from regency officials seeking promotion.

Anies on Reclamation: Corruption in the Making

Thanks to Jakarta governor Anies Baswedan’s recent statements about reclamation of North Jakarta, shares of Agung Podomoro (APLN) surged 8.85% to Rp246 on Friday (June 21). That means the stock gained 50% in about one month. Defending his policy in the issuance of building permits to the developers, Anies came up with his new version of definition of the islets. He classified them only as ‘extension of the beach’, not islets. 

On Fertilizer Distribution Case: The Trial

Two months ago the Corruption Eradication Commission (KPK) conducted an intense sting operation from the midnight of March 27, 2019, to the morning of March 28, 2019 and from then arrested eight individuals in total including one Bowo Sidik Pangarso (Golkar), member of the House Commission VI of the House of Representatives. The KPK announced the case on the evening of March 28, 2019, and said Bowo received bribes in return for his assistance to PT Humpuss Transportasi Kimia so that the Company could be responsible for providing transportation for distribution of fertilizer produced by the subsidiary of PT Pupuk Indonesia Holding Company (Persero). On June 19, 2019, the trial of the briber begin.
