Latest on the Riau Power Plant Graft Case 

The trial of Sofyan Basir, the former President Director of PT PLN (Persero) who is now a defendant in the Riau Power Plant graft case, continues. Earlier this week, the Court listened to the accounts of several key witnesses in the case. The prosecutors have been slowly revealing why they believe Sofyan Basir was involved in the scheme.

On the Jakarta Bay Reclamation Project 

Over a month ago we reported on the lawsuit filed against the Governor of Jakarta after he decided to stop the controversial reclamation project on the Jakarta Bay. Several months before that, there was another lawsuit also filed against the Governor related to the same project, but with a different object. And before that, the Governor was also sued by a different company but still related to the same project. So we know that the Governor is facing three lawsuits related to the Jakarta bay reclamation project. The lawsuits did not gain much attention, until two days ago when the public learned that the first lawsuit filed by PT Taman Harapan Indah, a subsidiary of PT Intiland Development Tbk (DILD), had been granted by the Jakarta State Administrative Court. What does this mean for the reclamation project? What should we expect for the other two ongoing proceedings?

On Meikarta Bribery Case : New Suspects

The trials of the suspects in the case of corruption involving the former Regent of Bekasi one Neneng Hassanah Yasin related to the Meikarta township project; a project developed by PT Mahkota Sentosa Utama, subsidiary of PT Lippo Cikarang Tbk (LPCK) were over a while ago. All suspects were declared guilty. That said, the Corruption Eradication Commission (KPK) won’t stop there. The KPK has decided to continue developing their investigation, targeting the names mentioned by the suspects and witnesses in the trials. 

PKPU Lawsuit against Kagum Karya Husada

On July 25, 2019 the Commercial Court at the Central Jakarta District Court registered a lawsuit on Suspension of Debts Payment (PKPU) filed against PT Kagum Karya Husada and its founder one Henry Husada (Kagum Group). The one filing the lawsuit is PT Bank Rakyat Indonesia Agroniaga Tbk (AGRO). There are no other details regarding the cause of the dispute, however, several information available in two other district courts pointed the Company’s apartment project named The Jarrdin @ Cihampelas as the problem.

KPK’s Latest Sting Operation: Regent of Kudus

The Corruption Eradication Commission (KPK) still have a lot of homework to be done regarding corruption and abuse of power in regional government, particularly the scheme of corruption by selling off structural positions. Because even with so many examples and ongoing inquisition related to similar cases, the practice still occurs. By the end of last week, the KPK arrested the Regent of Kudus along with several people, who they named suspects the day after, also for taking bribes in exchange to appoint a civil servant to a higher position. Kudus is hometown of Djarum cigarette, third largest behind Gudang Garam and HM Sampoerna.

Bill on Water Resources: Where are we now?

It has been over four years after the Constitutional Court through decision No. 85/PUU-XI/2013 granted the Judicial Review on Law No. 7/2004 on Water Resources and ruled that the Law unconstitutional. The Law and all of its technical regulations were thus annulled. The Government was forced to re-enact the Law No. 11/1974 on Irrigation and since then had enacted several ministerial level regulations to fill the absence of an up-to-date Law, but these are not enough.

Indosat v. Minister of Communication and Informatics

Last week the Jakarta State Administrative Court registered a lawsuit filed by PT Indosat Tbk (ISAT), a company in the process of divesting over 3,000 telco towers, against the Minister of Communication and Informatics. The court did not disclose all information related to the lawsuit other than that the Company demanded the court to annul a decree issued by the Minister back in April 2019. What is going on?

Sushi-Tei Indonesia v. Kusnadi Rahardja (1)

On July 25, 2019, Bisnis Indonesia reported that one Kusnadi Rahardja filed a tort lawsuit against PT Sushi-Tei Indonesia. From the news we learn that Kusnadi was Sushi-Tei’s president director recently dismissed from the Company. Kusnadi seems to have been fired without going through the proper mechanism and now he demanded compensation amounted to over Rp500 billion. In addition to suing Sushi-Tei Indonesia, Kusnadi also sues dozens of other parties, including Singapore-based Mizuho Asia Partners Pte Ltd.

On the Dispute in Kawasan Berikat Nusantara and Port Management

The past month has been a very busy month for PT Karya Teknik Utama (KTU), who together with PT Kawasan Berikat Nusantara (Persero) (KBN)—state owned bonded zone operator—founded PT Karya Citra Nusantara (KCN)—supposed to be the manager of the Marunda port in North Jakarta. After maintaining their low profile image, the dispute with their own partner forced the Company to step forward and explain the situation from their own perspective. But although the parties are struggling to win favor from the court and other stakeholders, thanks to the dispute, the public who initially weren’t so aware with the importance of anything related to port management, now begin to discuss the case. Now we notice that there are so many important aspects in port management that equally important, other than US$4 billion compensation demanded by KBN, and cannot be ignored.

Latest on the Water Supply Bribery Case

Two months ago the Corruption Court at the Central Jakarta District Court begin the trial of the bribees in the Drinking Water Supply System (SPAM) construction projects, all of the defendants are civil servants under the Ministry of Public Works and Public Housing. Despite the importance of the case, the trial went relatively quiet and far from spotlight. Last week the prosecutors of the Corruption Eradication Commission (KPK) had read their demands for the defendants and on July 24, 2019 the bribees read their plea.
