Setya Novanto’s Attempt for Reconsideration

Over a year ago the Corruption Court at the Central Jakarta District Court read their verdict for Setya Novanto, who many believe to be the mastermind of the E-KTP graft case. He was found guilty of all charges and sentenced to 15 years imprisonment. Setya Novanto did not immediately file for an appeal. Only recently we learned that Novanto wants to try his luck. He filed for a Reconsideration (PK). The first hearing for which was held on August 28, 2019, and Setya Novanto through his legal counsel Maqdir Ismail submitted five new evidence (novum). 

Update on the Bill on Water Resources

On August 26, 2019, over three years after the Bill on Water Resources was drafted, the House of Representatives and the Government finally agreed to continue the deliberation of the Bill to the second stage. This means we only have to wait for the upcoming plenary meeting.

Latest on Sofyan Basir’s Trial

The trial of Sofyan Basir, the former President Director of PT PLN (Persero) who is a suspect in the Riau Power Plant graft case, continues. On August 26, 2019, the Prosecutors summoned an expert witness who can explain the terms and conditions that applies on the articles used by the prosecutors in the indictment. As expected, the statements corner Sofyan’s position.

On the Prosecutors Graft Case: Enters MAKI

As we all know, within less than two months, the Corruption Eradication Commission (KPK) conducted two sting operations. They uncovered cases of corruption involving prosecutors in several different regions. The KPK and AGO must now face a new pre-trial lawsuit.

KSM Coal’s Bankruptcy

Over six years have passed since the last time we reported on the debts dispute of PT Kartika Selabumi Mining (also known as KSM Coal)—a coal producer based in East Kalimantan. The Company was able to resolve its dispute with its creditors with a peace agreement. The Company was also to dodge bankruptcy after the court rejected the objection petition against the peace agreement. Yet here we are, six years later, learning that the same court had granted the petition on the cancellation of peace agreement submitted by one of the Company’s creditors. Per August 14, 2019,   the Company is officially bankrupt, and the team of curators announced the bankruptcy process on August 26, 2019. 

KPPU’s Latest Decisions

The Business Competition Supervisory Commission (KPPU) is on a roll. Entering August 2019, the commission had already decided on dozens of cases. They also began an investigation on dozens of other cases, including important allegations of monopolistic practices in the aviation industry and even allegations of cartel-like practices in the salt industry and the fintech field. Last week, the KPPU announced that they had decided on two cases. One case is related to a case in East Nusa Tenggara, and another is related to a case in North Sumatera. 

On Tamin Sukardi’s Case: The Finish Line

It has been over a year since the Corruption Eradication Commission (KPK) uncovered the bribery involving Tamin Sukardi. The businessman allegedly bribed a judge of the Medan District Court in North Sumatera. By the end of last week the region’s prosecutors office announced that they had executed the legally binding verdict by handing over the object of the dispute to parties mandated by the Supreme Court. The verdict in question is related to the primary case on a land dispute which led to the bribery case.

Ongoing Examinations in the KPPU 

Two weeks after revealing their plan to examine dozens of cases related to alleged delay in notification of acquisition implicating dozens of companies, the Business Competition Supervisory Commission (KPPU) began the trial earlier this week. The first Company facing trial is PT Citra Prima Sejati, subsidiary of  PT Bumi Resources Tbk (BUMI).

Update on the Fertilizer Distribution Case

The Corruption Court at the Central Jakarta District Court has on August 21, 2019, read their verdict for the bribers in the bribery case involving Bowo Sidik Pangarso (a member of the Commission VI of the House of Representatives representing Golkar). On the same day, the same court listened to the prosecutors’ indictment for the intermediary in the case. 

KPK’s Latest Sting Operation

In less than two months, the Corruption Eradication Commission (KPK) conducted two sting operations which uncovered cases of alleged corruption involving prosecutors of several different regions. After unintentionally discovering two instances of corruption in Jakarta by the end of June 2019, the latest sting operation was conducted earlier this week in Yogyakarta and Solo, Central Java. Six prosecutors are mentioned in the cases. The series of sting operations have caused a stir in the Attorney General’s Office.
