On Constitutional Court decisions

On January 28, 2020, the Constitutional Court held a plenary session and submitted their 2019 annual report. The session was attended by many parties including President Joko “Jokowi” Widodo, Speaker of the House of Representatives Puan Maharani and Chief of the Supreme Court Hatta Ali. In the session, the Constitutional Court also conveyed the level of compliance to their decisions. Although the level of compliance is high, to date there are many decisions that have not been honored. The Chief Justice of the Constitutional Court Anwar Usman said that failure to comply with their decision is the same as disobeying the constitution.

Update on the Meikarta Bribery Case 

More than a year has passed since the Corruption Eradication Commission (KPK) uncovered the case of corruption involving the former Regent of Bekasi one Neneng Hassanah Yasin related to the Meikarta township project. The last time we reported on the progress was back in July 2019 when the KPK named new suspects in the case. Since then, one of the suspects has been prosecuted, and the trial is ongoing. The latest suspect in the case would reportedly face prosecution soon. 

On the Muara Enim Graft Case

Four months after the Corruption Eradication Commission (KPK) uncovered the corruption in Muara Enim, the Corruption Court of the Palembang District Court finally read their decision for one of the defendants. Meanwhile, the trial of the other defendant, including the disgraced Regent of Muara Enim one Ahmad Yani (Democratic Party) continues. 

Jiwasraya Case and Tan Kian

The Attorney General’s Office (AGO) is still busy completing their investigation into the corruption in state-owned insurance company PT Asuransi Jiwasraya. This week, the AGO is examining witnesses with knowledge of the case, including property baron Tan Kian. Tan Kian’s examination is widely reported around the nation, but this is not surprising news because the AGO had given a hint. Apart from the examination, the AGO said they would hold a case construction next week. Also, they had raided offices linked to several investment management companies. 

Corruption Journal 

The new leaders of the Corruption Eradication Commission (KPK) recently attended a meeting held by the House Commission II of the House of Representatives. The attendees discussed several things, including the status of halted cases. Several options were conveyed, including the possibility to terminate investigation. Meanwhile, the trial related to two cases of corruption involving the disgraced Regent of Riau Islands and PT Angkasa Pura II (Persero) continues. 

Challenging the Attorney General’s Office

Lokataru Foundation Executive Director one Haris Azhar, together with a researcher from Indonesian Corruption Watch (ICW) Kurnia Ramadhana, visited the Attorney General’s Office (AGO) on January 27, 2020. Both requested transparency in the status of assets owned by Lee Darmawan Kertarahardja a.k.a Lee Tjin Kiat. Lee was one of the graft convicts of a corruption case uncovered in the early 90s. For one reason or another, the assets confiscated were only handed over by Bank Indonesia to the AGO’s Center for Asset Recovery (PPA) in 2016. Now, Haris and ICW approached the AGO on the suspicion that there is asset embezzlement. Hearing the name Lee Darmawan, of course, we immediately remember the case involving former senior Prosecutor Chuck Suryosumpeno. Chuck was demoted from his position in 2015 with similar allegations, embezzling assets while serving as head of the PPA. The case was too odd that we don’t know who to trust anymore. But Chuck received support from many parties, including from Haris. Chuck was finally found guilty of corruption last year.

The Jiwasraya Case and Asset Recovery

The case of corruption involving State-owned insurance company PT Asuransi Jiwasraya (Persero) has taken a toll on a lot of parties. The Attorney General’s Office (AGO) is investigating the case, but the House of Representatives competes in establishing committees to investigate the case. Meanwhile, the State is now trying to find a quick solution to fulfill the Company’s obligation to its customers. Several options had been mentioned, including debt restructuring. However, can it be done?

Thohir Family and Dispute with BUMN

Since the end of 2019, the State has been preoccupied with various scandals and allegations of corruption involving several State-Owned Enterprises (BUMN). Minister of BUMN Erick Thohir has so far succeeded in creating the image of a Minister who is brave and resolute in facing all the problems. But lately, more and more problems have arisen, not only because of troubled BUMNs but also because of companies who are parties to the disputes. Some of which have links to the Thohir family. 

Latest on Emirsyah Satar’s Case 

The trial of Emirsyah Satar, the former president director of PT Garuda Indonesia (Persero) Tbk (GIAA), who allegedly involved in a corruption scheme together with Soetikno Soedarjo continues on January 23, 2020. In the latest hearing, the Corruption Court at the Central Jakarta District Court listened to the accounts of four witnesses. 

On Jiwasraya Case

The Attorney General’s Office (AGO) welcomed us in 2020 by naming five suspects in the case of corruption involving State-owned insurance company PT Asuransi Jiwasraya (Persero). Of the five suspects named, the public is focused on Benny Tjokrosaputro. This week, the AGO begins with meeting the House of Representatives and explaining their stance. For the past several days, the AGO had been informing the progress of investigation and inquisition. Among the development is their move to seized and secured assets belonging to the suspects, including thousands of land certificates and dozens of bank accounts. The House of Representatives also had suggested the AGO file bankruptcy lawsuit on over 50 investment management companies allegedly responsible in the case.
