Demands for Edhy Prabowo et al
The trial of former Minister of Marine and Fisheries Edhy Prabowo will soon end. On June 29, 2021, the prosecutors read their demands for Edhy and the other remaining defendants. Will the Corruption Eradication Commission (KPK) continue its investigation after the trial is over?
Demands for Rohadi
The former Registrar of North Jakarta District Court Rohadi, who was caught receiving bribes related to the case of sexual abuse involving a celebrity named Saipul Jamil, was found guilty in 2016. This seemingly trivial case became the Corruption Eradication Commission (KPK) ‘s entry point to discovering many more crimes that Rohadi allegedly committed since 2005. Rohadi was probably the richest registrar in Indonesia when his case came to light. He has everything and even has his own hospital. But we soon learn that Rohadi’s wealth is the proceeds of crime and the KPK named him suspect of money laundering. It took the KPK a long time to finish the investigation until the trial began four months ago, far from media coverage. On June 28, 2021, the prosecutors read their demands.
Much Needed Tax Reform (1)
Earlier this week, the House Commission XI of the House of Representatives held a working meeting with the Minister of Finance Sri Mulyani Indrawati. The meeting discussed the Government’s plans in the field of taxation. Minister Ani emphasized the importance of initiating tax reform and mentioned five scopes or groups included in the latest draft of the amendment to Law No. 6/1983 concerning General Provisions and Tax Procedures.
AGO v. TRAM
Two months ago, PT Jelajah Bahari Utama (PT JBU), an indirect subsidiary of PT Trada Alam Minera Tbk (TRAM) linked to Heru Hidayat, submitted an objection to the Attorney General’s Office (AGO). It objected to the institution’s plan to auction off some of the Company’s assets that are considered to be related to the allegations of corruption involving PT Asuransi Sosial Angkatan Bersenjata Republik Indonesia (familiarly known as PT ASABRI). However, the objection was not well received, and last week the announcement of the auction plan was made public. As a result, the two companies decided to file two separate lawsuits against the AGO’s decision to the Jakarta State Administrative Court (PTUN Jakarta).
On Sangihe Gold Reserve: Lawsuit
The granting of a mining operation permit on Sangihe Island in North Sulawesi has become a controversy. We noted some misinformation circulating in public. Last week, several representatives of the affected residents filed a lawsuit against the decision given to the mining company, but the lawsuit raises new questions.
The Criminals Behind Fictitious Tax Invoices
Law enforcement on tax violations continues to remain far from media coverage. On June 24, 2021, the Directorate of Law Enforcement at the Directorate General of Taxation reportedly handed over a suspect in the case of fabrication of fictitious tax invoices to the prosecutors’ office as a condition for the commencement of prosecution stage. The suspect is said to have filed a pre-trial but the lawsuit was rejected. Interestingly, the suspect turned out to be related to a case of a larger scale.
Government Financial Report
Recently, the Supreme Audit Agency (BPK) gave an Unqualified Opinion (WTP) on the Government Financial Report (LKPP) for the 2020 fiscal year. The result should be appreciated, but there are some notes, especially regarding the handling of the COVID-19 pandemic.
On Garuda Indonesia Corruption Case: Verdict for Hadinoto
The trial of Hadinoto Soedigno, Garuda Indonesia’s former executive vice director for Engineering and Maintenance Services, is over. Hadinoto stood trial for alleged involvement in the scheme of corruption conducted under the leadership of Emirsyah Satar. At the last hearing held on June 23, 2021, Hadinoto was found guilty of all charges.
PKPU for Waskita Beton
Another State-owned Enterprise subsidiary has to face the law after experiencing financial difficulties. On June 21, 2021, PT Waskita Beton Precast Tbk (WSBP) faced two different lawsuits of Suspension of Debt Payment (PKPU) at the Commercial Court at the Central Jakarta District Court. So far, Waskita Beton has faced four PKPU lawsuits.
