Towards the end of last week, the Office of Public Affairs of the US Department of Justice announced that SAP SE (ETR: SAP), a publicly traded global software company based in Germany, entered into a three-year deferred prosecution agreement (DPA) with the department. SAP’s resolution with the department stems from bribery schemes involving government officials in South Africa and Indonesia and several other countries. The department’s resolution is coordinated with prosecutorial authorities in South Africa, as well as with the SEC, while SAP will pay over U$220 million to resolve the investigations. The process reminds us of the similar DPA agreed by Rolls-Royce with the UK-based engineering company, Rolls-Royce, with Britain’s Serious Fraud Office (SFO), the agreement which finally uncovered the corruption in Garuda Indonesia.
