Law Journal: On Molucca Holding’s Lawsuit and Problems around AISA

It has been a while now since the dispute between Luxembourg’s Molucca Holdings S.à.r.l and PT Pelita Cengkareng Paper somehow went quiet. Earlier this week, PT Bank Permata Tbk (BNLI) finally gave a statement on the debt dispute. Separately, PT Tiga Pilar Sejahtera Food Tbk (AISA) reportedly dodged a bullet as the PKPU lawsuit filed at the Central Jakarta District Court was rejected. But other lawsuits are waiting for the Company, and one PKPU lawsuit filed against its subsidiaries at the Semarang District Court was recently granted.

On Molucca Holdings’ Lawsuit

The dispute between Luxembourg’s Molucca Holdings S.à.r.l and  PT Pelita Cengkareng Paper is getting more complicated. Molucca first attempted to force the paper company to pay their debts in mid-March 2018 when they filed for a lawsuit on Suspension of Debts Payment (PKPU). But the attempt failed. Molucca then filed for a second PKPU lawsuit within a day. But on May 7, 2018, the second attempt was also rejected by the Commercial Court.

On Molucca Holdings’ Lawsuit

Luxembourg’s Molucca Holdings S.à.r.l., as we previously reported, is the creditor with the biggest receivables in the PKPU process of Royal Standard group. The investment company apparently decided to make use of this moment to also file a PKPU lawsuit against paper company PT Pelita Cengkareng Paper. But PT Pelita Cengkareng Paper, represented by Hotman Paris Hutapea, refused to acknowledge their obligation and questioned Molucca Holdings’ legal standing.
